1. The competition is carried out by RechtEasy KG – hereinafter referred to as RechtEasy and the sponsor – on social media channels such as Facebook/Instagram and in cooperation with partners who provide the prizes for the competition. When conducting the competition, RechtEasy represents all of its cooperation partners. The competition is organized solely by RechtEasy. Neither Facebook/Instagram nor the cooperation partners providing the prizes enter into legal relationships with the participants in the competition. The competition is not connected to Facebook/Instagram and is in no way sponsored, supported or organized by Facebook/Instagram. Facebook/Instagram is not available as a contact person for the competition.

Participation in the competition is possible without exception under the conditions stated here. By participating, participants expressly accept these conditions.

2. Participation in the competition

2.1 Only persons of legal age with unlimited legal capacity are eligible to participate.

2.2 Employees of RechtEasy and its member companies as well as their close relatives are excluded from participation .

2.3 Participation in RechtEasy competitions takes place using the prize sections and/or competition cards issued by RechtEasy and/or online, including via the Facebook and Instagram accounts belonging to RechtEasy (Facebook page/Instagram account).

The following also applies to participation in competitions via Facebook and/or Instagram:

Participation takes place in the manner announced in the competition posting.
By uploading a photo to participate in the competition, the user confirms that they have not violated any rights of third parties or that they have created the image themselves. In addition, all people depicted must agree to this.
Illegal content is prohibited, especially content that is pornographic, promotes racial hatred or is inhumane.
The prize will be drawn after the expiry of the implementation period stated in the competition post, with the public excluded and with a guarantee of randomness, or in the manner announced in the competition post. If a participant violates the conditions of participation, RechtEasy is entitled to exclude them from the competition. People who provide false information about themselves, use unauthorized aids or try to gain advantages through manipulation may also be excluded. In these cases, RechtEasy is also entitled to revoke and/or reclaim any prizes that were initially awarded.

When participating in online competitions (e.g. Facebook, Instagram), comments that violate the platform guidelines, Austrian law, our netiquette and/or copyright will be removed without notice after we become aware of them. The participant is therefore excluded from the competition.

2.4 Participation is only possible from Austria and within the participation period specified by RechtEasy on the prize sections and participation cards and/or online, on Facebook and/or on Instagram.

2.5 Only one entry per person and competition is permitted. Multiple entries may be excluded from the competition.

2.6 Winners will be informed in writing or by telephone. Participants who have not won anything will not be informed.

The following applies to participation in competitions via Facebook and/or Instagram:

Winners will be informed via the comment function of the Facebook competition posting/Instagram posting and, if possible, also via the “private message” function.
Winners must send their contact and address details via “private message” to the RechtEasy Austria Facebook page/RechtEasy Instagram account or by email to info@rechteasy.at within 14 days (from notification of the winner) .

3. Gewinne

3.1 Die in den Ankündigungen und der Werbung für das Gewinnspiel abgebildeten Preise sind bloß schematisch abgebildet. Es können Abweichungen von Modell, Farbe oder anderer Eigenschaften bestehen.

3.2 Ein Anspruch auf Abgeltung des Gewinnes oder dessen Ausbezahlung in barem besteht nicht.

3.3 Die gegenüber RechtEasy bestehenden Gewinnansprüche dürfen weder verpfändet noch abgetreten werden.

3.4 Meldet sich ein/e Gewinner/in nicht innerhalb von vier Wochen, gerechnet ab dem Zeitpunkt der Verständigung, so verfällt sein/ihr Anspruch und RechtEasy ermittelt eine/n neue/n Gewinner/in in einer neuerlichen Auslosung. Der Anspruch auf Ausfolgung des Gewinnes erlischt gleichfalls, wenn diese Ausfolgung nicht innerhalb von -6 Monaten, gerechnet ab der Verständigung über den Gewinn, aus Gründen, die in der Person des Gewinners/der Gewinnerin liegen, erfolgen kann.

3.5 Die Übergabe des Gewinnes erfolgt beim nächstgelegenen Red Zac-Händler.

3.6 Bei Reise- und Gutscheingewinnen erfolgt die Abwicklung direkt zwischen dem/der Gewinner/in und den jeweiligen Kooperationspartnern von RechtEasy.

3.7 Die in dem Gewinnspiel ausgelobten und tatsächlich ausgefolgten Gewinne gelten als geschenkt. Nebenkosten, wie z.B. Anmeldekosten (z.B. bei Autos), allfällige Abgaben, Fahrtkosten usw. werden nicht übernommen. RechtEasy schließt, soweit dies gegenüber den Gewinnern/Gewinnerinnen rechtlich zulässig ist, Gewährleistungsansprüche im Zusammenhang mit den Gewinnen aus. Sie und ihre Kooperationspartner haften im Zusammenhang mit den verlosten Gewinnen nur für Schäden, welche sie und ihre Erfüllungsgehilfen vorsätzlich oder grob fahrlässig verursacht haben. Die Haftung für körperliche Schäden wird durch diesen Ausschluss nicht berührt.

3.8 Informationen über den Datenschutz (insb. Art. 13 EU-DSGVO):

Zur Durchführung und Abwicklung des Gewinnspiels ist RechtEasy berechtigt, die Personenangaben der an dem Gewinnspiel Teilnehmenden zu speichern und an seine Kooperationspartner zu übermitteln. Auch der Kooperationspartner ist insoweit zur Speicherung berechtigt. Die Teilnehmenden sind jedoch jederzeit berechtigt, die Einwilligung zur Speicherung ihrer personenbezogenen Angaben zu widerrufen und von der Teilnahme an dem Gewinnspiel zurückzutreten.
Jene Teilnehmer/innen an dem Gewinnspiel, die Preise gewinnen, stimmen im Vorhinein zu, dass RechtEasy und ihre Kooperationspartner in der Werbung/Öffentlichkeitsarbeit für ihre Gewinnspiele ihre Namen sowie Abbildungen/Videos der Preisübergabe veröffentlichen.

Teilnehmer/innen haben das Recht auf Auskunft, Berichtigung und Löschung sowie auf Einschränkung der Verarbeitung und die bereits genannten Widerspruchs- und Widerrufsrechte. Zusätzlich haben sie das Recht auf Beschwerde bei einer Aufsichtsbehörde.

3.9 Legal recourse is excluded; The participants do not (therefore) have a legal right to a prize.

3.10 RechtEasy is entitled to cancel the competition for objectively justified reasons, such as as a result of competition law disputes or for technical reasons. In this case, the participants have no claims against RechtEasy or their cooperation partners.

3.11 RechtEasy is entitled to modify these terms and conditions for objectively justified reasons, such as objections from competitors or for technical reasons.

3.12 The legal relationships arising between RechtEasy and the participants in the competition are subject to Austrian substantive law. Unless expressly regulated in these conditions, the provisions of the Austrian General Civil Code apply to the entire competition.
